Volleyball player arrested for DUI

Kennesaw State Volleyball setter McKinley Ferguson was arrested and booked on Oct. 12 at the Cobb County Adult Detention Center. She was charged with one count of DUI Less Safe.

According to a police report provided by the Kennesaw Police Department, Ferguson was involved in an accident near the intersection of Cherokee Street and Shiloh Road after being struck by another vehicle at roughly 8:30 p.m.

Ferguson was not at fault in the accident but, according to the report, the officer responding to the scene of the incident smelled alcohol on Ferguson’s breath and noticed what they observed as impaired speech and motion. She consented to a voluntary Standardized Field Sobriety Test after which she was placed under arrest.

The officer noted in their report there was a Preliminary Breath Test with a resulting blood alcohol content of .192 percent, and stated that Ferguson consented to a chemical test of her blood.

She was transported to the Kennesaw Police Headquarters to have her blood drawn, after which she was brought to the Cobb County Adult Detention Center without incident.

According to the Official Code of Georgia Annotated, the criteria to be met in order to charge a suspect with a DUI Less Safe is defined under O.C.G.A. § 40-6-391(a)(1).

This section states that, “(a) A person shall not drive or be in actual physical control of any moving vehicle while: (1) Under the influence of alcohol to the extent that it is less safe for the person to drive.”
